Texas Divorce Law

One of the primary family law issues in Texas is divorce. When going through a divorce, both sides of a married couple enter into a complex world of dividing up a relationship and parting ways. Some of the issues that can arise out of a Texas divorce case include:

• Alimony payments
• Separation of property
• Child custody
• Child visitation
• Child support
• Abuse issues

When an individual is going through divorce, it is common to need to present exemplary cases of why spousal support is needed, or why it should not be ordered. If one side of the couple had not been working for some time, temporary alimony payments may be ordered while the individual gets reacquainted with the work place.

Especially in longer marriages, there can be a great deal of property to divide between the partners. This can be an emotional issue for both sides, as many times, both sides want to stake claims with different pieces of property. It is not uncommon for parties to investigate prenuptial agreements when looking at who owns which pieces of property.

Children can be a point of high emotion in a Houston divorce case. Both sides in a marriage often want custody, or significant visitation in terms of the children.

Another common issue to arise in divorce cases is the accusation of abuse. Because divorce proceedings are highly emotionally charged, it is common for one spouse to bring up issues of spousal or child abuse. Many times, these charges result in protective orders being issued.

After the Divorce

Once the divorce is finalized, there are often legal issues that arise that require further legal assistance. When there are changes in child support or child custody circumstances, it is quite possible for a Houston divorce attorney to convince a Texas family court judge to make modifications to the existing rulings. If one of the parents has a pay increase or decrease, or if one of the parents loses a job, child support amounts can fluctuate.
