Houston Family Law

Families are complicated entities. Many families live in peace and harmony for years and years. Other families have legal issues and battles that need to be fought and won on an ongoing basis. Houston Child Custody Laws

In Texas, child custody is determined by a set of rules called “child possession.” Child possession in Texas has little to do with whether a child is living with one parent most or half of the time. Child possession has to do with raising and supporting the child. It also means that both parents of the child must work to support and raise the child into a healthy, functioning adult. There are three main parts to child possession laws in Texas:

• Sole conservatorship
• Possessory conservatorship
• Joint conservatorship

In a sole conservatorship case, one parent has custody and most of the rights to the child. In a possessory conservatorship case, one parent has sole custody and the other parent has visitation rights to the child. In a joint conservatorship case, there are practically equal rights for both parents and they share the responsibilities of caring for the child on a day-to-day or week-to-week basis. In such arrangements, while one parent may have custody of a child, the other parent may be required by the courts to make child custody payments in order to care for, and raise the child. Child possession rules in Texas determine which parent has possession of a child at any given time. Typically, both parents are required to support the child's growth and development.
